GENERAL BOOKING CONDITIONS
These General Booking Conditions (hereinafter referred to as General Conditions) will govern the commercial relationship that arises between ACCOMODATUM GESTION Y SERVICIOS SL and the user or client due to the contracting made through the forms that ACCOMODATUM GESTION Y SERVICIOS SL makes available on its website https://www.singularstays.com.
Booking through the websites of ACCOMODATUM GESTION Y SERVICIOS SL will imply the express acceptance, by the client or user of the pages, of these conditions, as well as the conditions of use established for the navigation of the user through the pages owned by ACCOMODATUM GESTION Y SERVICIOS SL.
These conditions will be applicable without prejudice to the application of the legal norms on the matter that are applicable to each case.
The General Contracting Conditions regulate the distance selling relationship between ACCOMODATUM GESTION Y SERVICIOS SL and the user or client, in accordance with the legal stipulations, especially Law 7/1998, of April 13, on General Contracting Conditions, Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, the current and applicable regulations on Personal Data Protection, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce.
ACCOMODATUM GESTION Y SERVICIOS SL reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. Such modifications may be made, through its websites, by any form admissible in law and will be of mandatory compliance during the time they are published on the web and until they are not validly modified by subsequent ones. However, ACCOMODATUM GESTION Y SERVICIOS SL reserves the right to apply, in certain cases, Particular Contracting Conditions with preference to these General Conditions when it deems appropriate, announcing them in due time and form.
Pre-booking Information
ACCOMODATUM GESTION Y SERVICIOS SL informs that the booking procedure through its web pages is detailed in the corresponding section for the formalization of the booking.
Also, ACCOMODATUM GESTION Y SERVICIOS SL informs that the user can access the conditions of use that it provides on the same web.
By booking with ACCOMODATUM GESTION Y SERVICIOS SL through its website, the user or client expressly declares to know, understand, and accept such conditions of use and the General Conditions. Similarly, the user declares to be of legal age and to have the legal capacity and to act necessary for the access to the websites of ACCOMODATUM GESTION Y SERVICIOS SL and the contracting through them. The user is responsible for treating confidentially and responsibly the identity and password obtained in the registration as a client, not being able to transfer them to another.
BOOKING OPERATION
Offer of bookings and price reference.
In compliance with the current regulations and, especially of Law 34/2002 on services of the information society and electronic commerce, ACCOMODATUM GESTION Y SERVICIOS SL offers in the corresponding section for the formalization of the booking information on all possible bookings, their characteristics, and prices. However, ACCOMODATUM GESTION Y SERVICIOS SL reserves the right to withdraw, replenish or change the offers offered to its customers through its website, by simply changing the content of them. In this way, the products and/or services offered at any time by the website of ACCOMODATUM GESTION Y SERVICIOS SL will be governed by the General Conditions in force at each time. Likewise, the company will have the faculty to stop offering, without prior notice and at any time, access to the mentioned products and/or services.
Indication of prices.
Each possible booking offered will have indicated its price and if it includes VAT or any other tax that, if applicable, is applicable. The prices indicated on the screen will be the current ones at each moment except for typographical error. When the price is different for the reason mentioned above, ACCOMODATUM GESTION Y SERVICIOS SL will communicate it to the client, via e-mail, before proceeding to charge the booking.
Availability.
The availability of the offers offered by ACCOMODATUM GESTION Y SERVICIOS SL through its website may vary depending on the demand of the clients. Although ACCOMODATUM GESTION Y SERVICIOS SL updates the database periodically, the booking requested by the client could be complete at that moment. In such a case, ACCOMODATUM GESTION Y SERVICIOS SL will send an e-mail to the client informing them of the impossibility of the availability of the offer.
Payment methods.
ACCOMODATUM GESTION Y SERVICIOS SL requests in the bookings through its website the data of a credit card, holder of the booking, to guarantee its effectiveness.
The client may pay the amount of their service opting for any of the following ways. During the purchase process, they must indicate their choice:
Credit card VISA or MASTERCARD
All operations involving the transmission of personal or bank data are carried out using a secure environment, a server based on the standard SSL (Secure Sockets Layer) security technology. All the information you transmit travels encrypted through the network.
Also, the data on your credit card is entered directly on the bank's page, in the TPV (Bank's Point of Sale Terminal) and is not entered or recorded on any server of ACCOMODATUM GESTION Y SERVICIOS SL.
When paying with VISA or MASTERCARD credit card, the following data will always be requested: the card number, the expiry date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.
This form of payment is valid only on the web.
When the amount of a purchase has been charged fraudulently or improperly using the number of a payment card, its holder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and re-credit entries in the accounts of the provider and the holder shall be made as soon as possible.
However, if the purchase had been indeed made by the cardholder and the demand for refund was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had improperly demanded the cancellation of the corresponding charge, he will be obligated to ACCOMODATUM GESTION Y SERVICIOS SL to compensate for the damages caused as a result of such cancellation.
Booking cancellation.
In case of booking cancellation by the client, the cancellation will be free until 10 days before the booking, that is, SingularStays will charge 1 night of the booking, 10 days before the arrival. This penalty is detailed in the file of each accommodation and also in the booking confirmation email. The booking cancellation must be requested by email to [email protected]
Cancellations will always be communicated in writing, by e-mail.
In the event that, due to force majeure, the booked apartment is not available, our company will offer you accommodation with identical characteristics. If no alternative could be offered, the booking will be canceled, and the amount paid in concept of booking will be returned.
Booking modification
Changes to bookings are always subject to availability and the maximum capacity of the property in question. In case the change implies an increase in the price of the booking, such increase must be paid.
In the case that the change implies a reduction in the price of the booking, for the refund of the amounts, it will be treated as a cancellation. To modify a booking, you must send an email to [email protected], attaching a copy of the email you received when confirming the booking.
Withdrawal.
As established in article 103 of Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, supplies of services or goods made according to the consumer's specifications or clearly personalized, or that, by their nature, cannot be returned or can deteriorate or expire quickly, are exempt from withdrawal.
DATA PROTECTION
In accordance with the provisions of the current regulations on Personal Data Protection, we inform you that your data will be incorporated into the treatment system owned by ACCOMODATUM GESTION Y SERVICIOS SL with CIF B98258874 and registered office at PASAJE DE GINER, 2 46001, VALENCIA, with the purpose of being able to facilitate, expedite and fulfill the commitments established between both parties. In compliance with current regulations, ACCOMODATUM GESTION Y SERVICIOS SL informs that the data will be kept for the strictly necessary period to comply with the aforementioned precepts.
ACCOMODATUM GESTION Y SERVICIOS SL informs that it will proceed to treat the data in a lawful, loyal, transparent, adequate, relevant, limited, accurate and up-to-date manner. That is why ACCOMODATUM GESTION Y SERVICIOS SL commits to adopt all reasonable measures so that these are deleted or rectified without delay when they are inaccurate.
According to the rights conferred by the current regulations on data protection, you may exercise the rights of access, rectification, limitation of treatment, deletion, portability and opposition to the processing of your personal data as well as the consent given for the treatment of them, directing your request to the postal address indicated above or to the email [email protected].
You may go to the competent Control Authority to present the claim you consider appropriate.
APPLICABLE LEGISLATION AND JURISDICTION
Likewise, ACCOMODATUM GESTION Y SERVICIOS SL reserves the right to file civil or criminal actions it deems appropriate for the improper use of its website and contents or for the breach of these conditions.
The relationship between the user and the provider will be governed by the current and applicable regulations in the Spanish territory. Should any controversy arise, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction complying with the rules on jurisdiction and competence in this regard.
